Austin DWI

If you’ve landed on this website, chances are that you or someone you care about have been charged with driving while intoxicated (DWI) in Austin, TX. While many people mistakenly believe that fighting their case isn’t worth it, the truth is that there are a number of potential defenses that will not only allow you to get a reduced sentence, but to even have your charges dismissed or acquitted. Austin DWI Attorney Ken Gibson has helped a number of clients obtain a favorable outcome for their cases, and, thanks to his years of experience and knowledge on the subject of drunk-driving defense, he can also help you.

Potential Penalties for a Conviction

Some people don’t realize that pleading guilty to DWI is the same thing as going to trial and being convicted; however, you will face the same penalties either way. For this reason, it may be worth working with a DWI defense attorney and exploring your options.

The penalties for a Texas DWI are based on the number of prior drunk-driving convictions on your criminal record. For a first offense, you could be sentenced to three to 180 days behind bars, up to $2,000 in court fines, and a license suspension for 90 days to one year. If convicted of a second offense, your punishment will be increased to 30 days to 1 year in jail, up to $4,000 in fines, and a license suspension for 180 days to 2 years. In addition, you will be required to mount an ignition interlock device in all of the vehicles registered under your name–at your own expense.

How to Win Your DWI Case

This may sound simple, but the biggest key to winning your DWI is to not plead guilty. When meeting with defense attorneys, it is important to ask how many cases they have pled–if they advise a large number of clients to plead guilty in exchange for a reduced sentence, they may not be the right lawyer for you.

Attorney Gibson believes that preparation also means the difference between winning and losing a DWI case. By carefully reviewing the facts in your case–including the police report and your breathalyzer or blood reading–he can uncover any evidence that will bolster your defense. In fact, by the time he is done investigating the circumstances of your arrest, he often knows more about your case than the arresting officer or the prosecution.
